Terms & Conditions

1) Definitions

(a) “Client” means the person or organisation to whom the invoice is addressed to (whether or not the Client is acting for a third party). (b) “Photo” means any photograph, transparency, negative, design, digital image file or any other item which may be offered for the purpose of reproduction taken by New Pixels Photography. (c) “Photographer” means New Pixels Photography [Delfcroft, Ware]

2) Services

This is a contract for wedding photography/event photography services and products provided by the Photographer to the Client, the details of which are [set out above/have been agreed by both parties].

3) The Event/Wedding

a) The Photographer agrees to be in attendance on the date of the event and to provide the Client with the photography package [set out above/agreed with the Client]. b) If the Photographer is unable to attend the wedding/event due to illness or any other unforeseen circumstances, a suitable replacement photographer will be provided by the Photographer. c) The Client confirms that the bride, groom and any guests present at the wedding can be photographed without any further permission. If the Client or any of the guests have any concerns, the Client must notify the Photographer as soon as possible. d) The Client acknowledges and agrees that no other professional photographer will be allowed to photographs at the wedding while the Photographer is working.

4) Payment

a) The Client agrees to pay a 30% non-refundable deposit to secure the relevant date and understands that in the event of any cancellation this deposit is non-refundable and non-transferable to any other products or services b) The Client agrees to pay the full remaining balance for the photography package purchased no later than 30 days before the wedding date in two separate instalments and understands that in the event of any cancellation instalments are non-refundable and non-transferable.

5) Copyright

a) The copyright and all other rights in any Photos taken remain the property of the Photographer and the Client acknowledges that any Photos taken at the wedding/event may be used by the Photographer for advertising, competitions or promotional purposes. b) Following the event/wedding, all Photos will be uploaded to a password-protected private wedding gallery to be viewed by the Client and their guests. A password will be provided to the Client after the photos have been uploaded. It is the Client’s responsibility to inform the Photographer if they require any Photos to be removed from the online viewing gallery. c) If, as part of the wedding photography package, the Client is provided with a digital file containing Photos, the Photos may be printed and/or displayed online for personal use but in no circumstances can they be used for commercial activities unless agreed in advance and in writing by the Photographer.

6) Cancellation

a) In the unlikely event of total or part photographic failure, equipment failure, hard drive failure, memory card failure, theft, death, injury or illness, accident or other unforeseen circumstances beyond the Photographer’s control, the Photographer’s liability shall be limited to a full refund of all moneys paid and the Photographer shall not be responsible for other indirect or consequential loss.
